These Terms & Conditions (“Terms”) govern the purchase and use of all online courses and behind-the-wheel driving courses provided by Brown's Driving School LLC (“we,” “us,” or “our”). By purchasing or accessing any course, you agree to be bound by these Terms.

1. Digital Products & Online Course Delivery

All online courses are digital, non-tangible products.
Access is delivered electronically via email or online portal after payment is successfully processed.

It is the customer’s responsibility to provide a valid email address and ensure delivery by checking spam or junk folders.

2. Online Course Refund Policy

ALL SALES ARE FINAL.

Once course access has been delivered, no refunds, exchanges, credits, or reversals will be issued, including but not limited to situations involving:

• Failure to complete the course
• Scheduling conflicts
• Change of mind
• Technical issues related to the user’s device, browser, internet connection, or email provider
• Failure to check email or spam/junk folders
   

Refunds, if approved, are issued at our sole discretion.
If a refund is granted, all payment processing, platform, and transaction fees charged to us by Square or the card issuer are non-refundable and will be deducted from the refund amount. The customer will receive a refund less all non-refundable fees.

3. Chargebacks & Payment Disputes

By completing a purchase, you agree not to file a chargeback or payment dispute for reasons related to:

• Non-refundability
• Non-use of the course
• User error
• Technical issues on the customer’s end

Customers must contact us first to attempt resolution before initiating any dispute. Unauthorized or abusive chargebacks may result in termination of access without refund and restriction from future purchases.

4. Technology Requirements

Customers are responsible for ensuring they have:

• A compatible device (computer, tablet, or smartphone)
• Reliable internet access
• An up-to-date web browser
• A functioning email account

We are not responsible for access issues caused by customer equipment or services.

5. Online Course Completion & Outcomes

Completion of any online course does not guarantee:

• Passing a state, DMV, or third-party exam
• License issuance or reinstatement
• Insurance discounts
• Employment, certification, or approval by any agency

5.1 Additional Fees

•  30-Hour Online Driver's Education Course Exam Retest Fee (after 2nd failed attempt): $20 for each subsequent exam attempt. (Cash or Secure Bank Transfer/ACH only)
• Online course replacement certificate: $25 (Cash or Secure Bank Transfer/ACH only)
   

Results depend on individual performance and external requirements.

6. Intellectual Property & Use Restrictions

All course content is the intellectual property of Brown’s Driving School, LLC.

Customers may not:

• Share login credentials
• Copy, record, download, reproduce, or distribute content
• Provide access to any third party
   

Violations may result in immediate termination of access without refund and possible legal action.

7.  Behind-the-Wheel (BTW) Driving Courses 

7.1 License Certification
Brown’s Driving School, LLC agrees to provide:

• Fourteen (14) hours of Behind-the-Wheel instruction, consisting of seven (7) periods of driving and seven (7) periods of observation
• Each session is at least fifty (50) minutes

Teen Students (Under 18):

• $385.00 (Credit/Debit Card Rate)
• $370.00 (Cash or Secure Bank Transfer/ACH Rate)

Adult Students (18+):

• $400.00 (Credit/Debit Card Rate)
• $385.00 (Cash or Secure Bank Transfer/ACH Rate)
• Accepted payment methods: Credit or debit card, cash, secure electronic bank transfer (ACH), money order or check payable to Brown’s Driving School, LLC

Payment is due on the first day of sessions or the evening prior if paying electronically.

7.2 Practice Driving Sessions

50-Minute Practice Session:

• $70.00 (Credit/Debit Card Rate)
• $65.00 (Cash or Secure Bank Transfer/ACH Rate)

Payment is due on the day of the scheduled session or the evening prior if paying electronically. Instruction will not begin until payment has been received.

7.3 Payment Structure Disclosure

• Published prices reflect standard credit/debit card payment rates.
• A discounted rate is offered for customers who choose to pay by cash or secure electronic bank transfer (ACH).
• All pricing and payment options are disclosed prior to enrollment.

7.4 Refund Policy

• A full or partial refund may be issued within 120 days of registration only if the school is unable or unwilling to perform its obligations under this agreement.
  • Refunds, if approved, will be issued in the original form of payment.
  • Non-refundable processing fees charged by third-party payment processors are not refundable.

7.5 Additional Fees

• Retake of road skills test: $45 (Cash or ACH only)
• Returned check fee: $35 (Cash or ACH only)
• Lost certificate replacement: $25 (Cash or ACH only)

All fees must be paid in full before a Certificate of Completion is issued.
 

7.6 Scheduling, Cancellations & No-Shows

• BTW instruction is by appointment only upon receipt of BTW contract
• Late cancellations or no-shows result in forfeited lessons without refund, unless at least a 24-hour notice is provided.
• Course completion may be delayed by mechanical failure, weather, or circumstances beyond the school’s control.
• Canceled classes will be rescheduled.
   

7.7 Conduct & Safety

• Students are responsible for behavior and may be dismissed without refund for misbehavior
• No food, drink, smoking, sleeping; phones off or on vibrate
• Proper hygiene required
• Family/friends may not ride along during instruction
• The school is not responsible for personal belongings left in the vehicle
   

7.8 Risk Acknowledgment

• Students assume all risks inherent in driving and operation of a motor vehicle during instruction
• Vehicles are fully covered with at least liability insurance
• Completion of BTW instruction does not guarantee a fully safe or accomplished driver; repeated practice is required to develop skills
   

7.9 Instructor Limitations

• No more than three students per session
• Instructor discretion determines whether a student may drive for safety reasons
   

7.10 Certificates & DMV Compliance

• Students completing the course receive the Virginia Driver Training Completion Certificate (DTS-D-Adults or DTS-B-Teens) or Reexamination Certificate (DTS-C) as applicable
• Brown's Driving School LLC is responsible for mailing certificates to the DMV after student has completed all state-required testing
   

7.11 Student/Parent Responsibilities

• Report any physical, mental, or intellectual deficits affecting driving or learning.
• Notify DMV of any concerns regarding school, instructor behavior, or instruction quality.
   

8. Account Termination

We reserve the right to suspend or terminate access for violations of these Terms without refund.

9. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

10. Acceptance of Terms

By purchasing or accessing our online courses or Behind-the-Wheel courses, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
